The terms governing access to and use of the PetCue iOS application and its subscription.

1About these Terms

These Terms & Conditions (“Terms”) form an agreement between you and Fabian Michał Rzadkiewicz, a sole trader established in Poland, with the business address Gdańska 125/7, 85-022 Bydgoszcz, Poland (“PetCue”, “we”, “us”, or “our”). They govern your use of the PetCue iOS application, related content, and support services.

By downloading, subscribing to, or using PetCue, you agree to these Terms. If you do not agree, do not use PetCue. Apple is not a party to these Terms, except that Apple and its subsidiaries are third-party beneficiaries of the licence provisions applicable to the iOS app and may enforce them as permitted by Apple’s rules.

2Eligibility and family use

PetCue is not directed to children under 13. If you are under 18, you may use PetCue only with the permission and supervision of a parent or legal guardian. A subscription must be purchased or authorized by an adult using that adult’s Apple account. The adult is responsible for supervised use and compliance with these Terms.

3What PetCue does

PetCue helps cat parents organize care routines, record observations, preserve locally stored health history, manage reminders, and prepare summaries for veterinary visits. Features and availability may vary by device, operating-system version, language, region, and subscription status.

Veterinary disclaimer: PetCue is an organizational and educational tool, not a veterinary service or medical device. It does not diagnose, prevent, monitor, predict, treat, or cure disease and cannot determine whether your cat needs urgent care. Always seek a qualified veterinarian’s advice. In an emergency, contact a veterinarian or emergency clinic immediately.

4Licence and permitted use

Subject to these Terms and payment of applicable subscription fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use PetCue on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules, for personal and non-commercial purposes.

You must not:

  • copy, sell, rent, sublicense, distribute, or commercially exploit PetCue except where law expressly permits;
  • reverse engineer, decompile, disassemble, bypass, or interfere with PetCue or its subscription controls, except to the limited extent that applicable law does not allow such restriction;
  • use PetCue unlawfully, introduce malicious code, attempt unauthorized access, or misuse support channels;
  • misrepresent PetCue-generated summaries as a veterinarian’s diagnosis or professional medical record.

5Your records and responsibilities

You remain responsible for the accuracy, completeness, interpretation, and lawful use of information you enter. PetCue may help organize observations but cannot verify them. Do not delay veterinary care because of an app entry, score, reminder, report, or absence of a warning.

Your cat-care content is primarily stored on your device and may be included in iCloud backup or synchronization if enabled. You are responsible for maintaining appropriate device and iCloud security, reviewing backups, and keeping independent copies of information you cannot afford to lose. Deleting the app, changing devices, disabling iCloud, software errors, or device loss may result in data loss.

6Subscriptions, prices, and trial

PetCue offers auto-renewing subscriptions through Apple’s App Store:

  • Monthly: USD 7.99 per month in the United States storefront.
  • Annual: USD 49.99 per year in the United States storefront, with a one-month introductory free trial for eligible users.

Apple displays the final price, currency, taxes, eligibility, and any localized equivalent before purchase. Prices may differ by country or storefront and may change. The offer displayed in the App Store purchase sheet controls if it differs from this description.

The annual free trial is available only where and to whom Apple presents it. Unless cancelled before the trial ends, the annual subscription automatically converts to a paid annual subscription at the price shown by Apple. Apple may restrict trial eligibility based on prior subscriptions or introductory offers.

7Billing and automatic renewal

Payment is charged to your Apple ID account when you confirm the purchase or, for an eligible free trial, when the trial converts to a paid subscription. Subscriptions renew automatically for the same billing period unless cancelled through Apple before renewal. Apple may charge the renewal price within the period stated in its subscription terms.

RevenueCat validates transactions and manages PetCue subscription entitlements, but it does not replace Apple as the App Store payment provider. We do not receive your full payment-card details.

8Cancellation, refunds, and restoring purchases

  1. Cancel through your Apple ID subscription settings. Deleting PetCue does not cancel a subscription.
  2. Cancellation normally takes effect at the end of the current paid period. You generally retain access until then.
  3. Refund requests for App Store purchases must be submitted to Apple and are decided under Apple’s rules and applicable law. RevenueCat may detect and reflect Apple’s refund decision in your entitlement status but does not make Apple’s refund decision.
  4. Use PetCue’s restore-purchases function where available to restore an eligible subscription associated with your Apple account.

Nothing in these Terms limits a refund, withdrawal right, price-protection right, or other remedy that cannot lawfully be excluded in your country.

9Consumer withdrawal rights

If you are an EEA or UK consumer, digital-content and service rules may provide a cancellation or withdrawal right. For immediately supplied digital content or services, that right may be affected once performance begins with your prior consent and acknowledgment, as presented during Apple’s purchase flow. Any mandatory consumer right remains unaffected. App Store refund and withdrawal requests are administered through Apple.

10Updates, compatibility, and availability

We may release fixes, security updates, new features, or changes to PetCue. Some updates may be required for continued use. We do not promise that every feature will remain available, work on every device, or be uninterrupted or error-free. We may modify or discontinue a feature for legitimate operational, legal, safety, or technical reasons, subject to mandatory consumer law.

11Intellectual property

PetCue, including its software, design, text, graphics, trademarks, and original content, is owned by or licensed to us and protected by intellectual-property laws. These Terms grant only the limited right to use the app. You retain rights in content you create or enter. You grant us no general right to access locally stored cat-care content.

12Third-party services

PetCue relies on services provided by Apple, including the App Store and iCloud, and on RevenueCat for subscription infrastructure. Product analytics may be provided by PostHog. Those services may be governed by their own terms and privacy policies. We are not responsible for third-party services beyond responsibilities that applicable law places on us.

13No professional advice

Any educational text, pattern, reminder, summary, or suggested next step is general information only. It is not a substitute for professional judgment. Veterinary decisions must be made by you with a qualified veterinarian who can examine the animal and consider its complete history. You assume responsibility for acting on, sharing, or relying on records you enter or export.

14Disclaimers

To the maximum extent permitted by law, PetCue is provided “as is” and “as available.” We disclaim implied warranties to the extent they may lawfully be excluded. We do not guarantee that reminders will always be delivered, records will never be lost, analytics will identify every issue, or PetCue will meet every veterinary or personal requirement. Mandatory statutory guarantees and consumer rights remain unaffected.

15Limitation of liability

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for fraud, wilful misconduct, death or personal injury caused by negligence where applicable, or mandatory consumer remedies. Subject to that rule, we are not liable for indirect or consequential loss, loss of data, missed reminders, loss caused by inaccurate entries, or decisions made without appropriate veterinary advice.

Where a financial cap is legally permitted, our aggregate liability arising from PetCue will not exceed the greater of the subscription fees you paid for PetCue during the 12 months before the event giving rise to the claim or USD 50. This cap does not apply where mandatory law requires a higher or uncapped remedy.

16Suspension and termination

You may stop using PetCue at any time, but you must separately cancel the subscription through Apple. We may suspend or terminate access if you materially breach these Terms, misuse the app, threaten security, or if continued service becomes unlawful, subject to any notice and remedy rights required by law. Terms concerning ownership, disclaimers, liability, disputes, and accrued rights survive termination where their nature requires.

17Governing law and disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections available under the law of your habitual residence. Courts will have jurisdiction as determined by mandatory applicable law; nothing here requires a consumer to bring proceedings only in Poland where local law grants another forum.

Before starting formal proceedings, please contact support@petcueapp.com so we can try to resolve the issue. This does not limit any deadline or mandatory right to contact a court, regulator, consumer authority, or alternative-dispute body.

18Changes to these Terms

We may update these Terms for legal, security, technical, or product reasons. We will publish the revised Terms with a new effective date and provide additional notice where required. Changes will not retroactively remove rights already accrued. If a material change requires consent under applicable law, we will request it.

19General provisions

If part of these Terms is held unenforceable, the remaining provisions continue to apply, and the affected provision will be interpreted as closely as legally possible to its intended purpose. A delay in enforcing a right is not a waiver. You may not transfer this agreement without our consent, except where mandatory law permits. We may transfer it as part of a legitimate business reorganization, provided your mandatory rights are preserved.
