The terms for using PetCue, its care-organizing features and access offers.
1About these Terms
These Terms govern the PetCue iOS application and related services provided by Yanfang Shen in an individual capacity, not as an incorporated company. “PetCue”, “we”, “us” and “our” refer to Yanfang Shen. PetCue was created by Fabian-Michael Rzadkiewicz; creator credit does not change the service provider identified here.
These Terms apply when made available and accepted in connection with your use of PetCue, to the extent permitted by applicable law. Nothing here removes a right that cannot lawfully be excluded.
2App licence and Apple
The software licence supplied through the App Store governs your right to use the app. Apple’s Standard End User License Agreement applies unless an applicable custom EULA is provided through the App Store. These Terms supplement the applicable licence for PetCue’s services and offers; they do not replace Apple’s purchase terms or override mandatory consumer rights.
PetCue is a third-party app provided by Yanfang Shen, not by Apple. Contact us for PetCue support. Apple administers its own App Store, account, payment and refund services. Nothing in these Terms changes responsibilities or rights established by the applicable EULA, Apple’s terms or law.
3What PetCue does
PetCue helps you organize care routines, record observations, keep a cat-care history, receive reminders and prepare information for veterinary visits. Availability depends on the app version, device, operating system, language, region and access level.
PetCue is not a veterinary service or a substitute for professional examination, diagnosis or treatment. It does not establish that a cat is healthy or determine whether urgent care is needed. Reminders, summaries and suggested routines are general organizational aids. Follow your veterinarian’s advice and contact a veterinarian promptly when needed.
4Eligibility
PetCue is not directed to children under 13, or a higher threshold required by applicable law. Minors should use it with appropriate parental or guardian involvement. Any purchase must be made or authorized by an adult using an eligible Apple account.
5Your content and permitted use
You are responsible for the information you enter, your decisions about care and the records you choose to share. You retain your rights in your own content. Using PetCue does not grant us a general right to access locally stored care records. Information you deliberately send to support is handled under the Privacy Policy.
Use PetCue lawfully and in accordance with the applicable licence. Do not misuse access codes, bypass access controls, interfere with security, infringe another person’s rights, or present app-generated material as a diagnosis issued by a veterinarian. Restrictions do not remove exceptions or rights provided by law or applicable open-source licences.
Care records are primarily stored on your device and may be included in available iCloud backup or synchronization. Keep appropriate backups and protect your device and Apple account. Deleting the app, losing a device, disabling synchronization or software faults can affect access to data. These practical responsibilities do not remove our legal obligations.
6Prices and auto-renewing subscriptions
Where offered, PetCue provides monthly and annual auto-renewing subscriptions through Apple’s App Store. The published United States reference prices are USD 7.99 per month and USD 49.99 per year. An eligible annual offer may include a one-month introductory free trial. Availability, eligibility and localized prices can differ.
Apple shows the applicable price, currency, billing period, taxes and offer terms before you confirm. Those purchase terms govern your transaction. A general website description does not remove a right arising from the offer actually made to you.
An auto-renewing subscription continues and may be charged for the next period unless you cancel through Apple before renewal under the terms shown by Apple. An introductory free trial attached to such a subscription can convert to paid access unless cancelled in time. We do not receive your full payment-card details. RevenueCat assists with transaction validation and access management.
7Adoption, partner and fixed-term access
Eligible adoption or partner offers may provide access for a stated period, such as one year, or a lifetime grant. The specific benefit, eligibility, activation conditions and expiry or renewal terms must be disclosed with the offer. A code may be restricted to eligible recipients and any disclosed redemption limits.
A fixed-term grant that does not create or continue an auto-renewing subscription expires at the end of its stated period without a new charge for that grant. An offer applied to an Apple auto-renewing subscription follows the renewal terms disclosed in Apple’s offer and subscription management screens. Do not infer renewal behavior solely from the words “free” or “one year”.
Activating an access code does not automatically cancel a separate subscription you already hold. Review existing subscriptions in your Apple account and contact us if the access shown in PetCue does not match the redeemed offer.
8Lifetime access
Where offered, a lifetime entitlement has no scheduled expiry and is not itself an auto-renewing subscription. No recurring subscription charge is created by that entitlement. The scope of premium access is the scope described when the grant or purchase is made.
Lifetime access does not guarantee that a particular device will remain supported forever, or include every separately offered future product or service. We will not treat this qualification as permission to arbitrarily revoke the access granted. If a material service change affects your rights, applicable consumer remedies remain available. A separate existing Apple subscription must still be cancelled separately if you no longer want it.
9Cancellation, refunds and restoration
Manage and cancel auto-renewing subscriptions through your Apple account’s subscription settings. Deleting PetCue does not cancel them. Cancellation generally stops the next renewal while access continues for the remaining period, subject to Apple’s applicable trial, refund and purchase terms.
App Store refund requests should be submitted to Apple. Decisions follow Apple’s rules and applicable law. Contact PetCue support for access problems or other remedies for which we are responsible; these Terms do not make Apple’s process your only remedy where the law provides another one.
Use the app’s restoration function, where available, with the Apple account associated with the original transaction. Eligible subscription and non-consumable entitlements may be restored according to Apple and the offer’s rules. Restoration does not itself restore locally stored care records; those depend on your device, backups and available synchronization.
Statutory cancellation, withdrawal, refund and conformity rights remain unaffected. Where immediate delivery of digital content or services affects a withdrawal right, any legally required consent and acknowledgment must be obtained in the applicable purchase flow; acceptance of these Terms alone is not a blanket waiver.
10Updates and availability
We may provide fixes, security updates and product changes. Install updates needed for safe and compatible use. We do not promise uninterrupted service or compatibility with every future device or operating system.
We may change or discontinue functionality for legitimate operational, security or legal reasons, subject to applicable consumer obligations. We will give notice of material changes where required and preserve any required refund, termination or other remedy. Changes will not retrospectively remove accrued rights.
11Ownership and third-party services
PetCue’s software, design, branding and other materials are owned by their respective rights holders or used under licence. Yanfang Shen is the identified publisher and service provider; Fabian-Michael Rzadkiewicz is credited as creator. These Terms and that credit do not themselves transfer intellectual-property ownership.
Apple, iCloud, RevenueCat and, where enabled, PostHog provide separate services under applicable terms and privacy policies. You must comply with relevant third-party terms when using those services. We remain responsible for obligations that applicable law places on us.
12Privacy
Our Privacy Policy explains local care content, iCloud, purchase/access information, analytics and support. No PetCue login is required. Accepting these Terms is not consent to processing that requires separate consent.
13Responsibility and limitations
Reminders depend on the device, permissions and system conditions. Care summaries depend on the information entered. Keep independent arrangements for important care, and do not delay veterinary help because of an app entry or the absence of a warning.
We remain responsible for losses and remedies to the extent required by applicable law. Where law permits a limitation, we are not responsible for losses that were not reasonably foreseeable when the agreement was made, or business losses arising from use of a consumer app. Nothing here excludes or limits liability for fraud, intentional misconduct, gross negligence where it cannot be excluded, death or personal injury where applicable law prohibits exclusion, or any mandatory consumer protection.
Any warranty disclaimer or limitation under the applicable software licence applies only to the extent lawful. No statement in these Terms removes a statutory guarantee, a right to a conforming digital service or another non-excludable remedy.
14Suspension and ending use
You may stop using PetCue at any time; separately cancel an Apple subscription to stop future renewal. We may restrict access for a material breach, fraud, security risk or legal requirement, with notice and an opportunity to address the issue where appropriate and required. Any restriction must respect applicable consumer rights. Paid or granted access is not revocable merely because the publisher changes.
15Applicable law and disputes
Applicable law and the courts with jurisdiction are determined under the relevant legal rules, including mandatory consumer protections. These Terms do not impose exclusive proceedings in China or waive a consumer’s right to use a court or regulator available under applicable law. Any governing-law provision in the applicable App Store licence operates subject to those protections.
Please contact support@petcueapp.com so we can try to resolve concerns. This does not limit other remedies or extend any legal deadline.
16Changes and general provisions
We may update these Terms for legal, security, operational or product reasons, with a new effective date and additional notice or consent where required. Changes apply prospectively and do not remove accrued rights. If a provision is unenforceable, the remaining provisions continue to the extent lawful. A business transfer must preserve applicable rights and satisfy any required notice or consent obligations.
